Collective Bargaining Agreement
Describe how this is similar to a “contract” between management and labor. Do you believe it is written at the correct level of detail?
The document is similar to a contract between labor and management since it involves an agreement between two parties. One of the parties represents labor, while the other represents management, creating a contract between management and labor. The document is also similar to a contract between labor and management because the two parties involved have an intention to create a legal relationship (Eisenberg, 2018). This is evident in the Articles regulating how things shall be done and the consequences of various actions.
The document is also similar to a contract between labor and management because it includes a monetary consideration (Smith & McKinlay, 2009). The document is additionally similar to a contract between labor and management because it covers community activities, membership services, collective bargaining, and worker relations (Emeritus Professor of Employment Law Mark Freedland et al., 2016). It also covers the essential elements of a contract between labor and management which are job protections, wages, working conditions, and benefits.
I believe the document is written at the right level of detail because it provides a detailed explanation of every provision. The details provided are also specific and easy to interpret. For instance, in the grievances and arbitration section, the document explains the steps to be followed to address grievances and an explanation for any exemptions that could be made. In the Union Security section, the document provides an example of how a written authorization should look like.
Do you believe this document adds value to a workplace, or does it create restrictions?
I believe this document adds value to a workplace by eliminating misunderstandings between management and labor because everyone knows what is expected of them. For instance, it states the responsibilities of both employees and employers and the consequences for failing to meet the responsibilities, hence creating a foundation for the policies and procedures to be used.
