The Existence of a Contract in Lambert v. Barron- Key Facts and Case Analysis

The Existence of a Contract in Lambert v. Barron- Key Facts and Case Analysis

In this case, a unilateral contract existed between Lambert and Baron. First, Lambert offered to provide consultation services for one year at a rate of $3100 per month. When invoiced, Barron paid once and declined to make another payment (Thomson Reuters, 2021). Despite the lack of explicit acceptance of the offer, Baron’s silence and subsequent payment confirm the existence of a contract (Web Solutions LLC., 2021). His conduct was sufficient to make Lambert believe that they had a legally binding contract (Allen & Overy, 2016).

On the other hand, Baron has sufficient reason to believe that there is no contract. The lack of an oral acceptance from Baron is one of the factors that nullify the contract’s existence. Despite having a conversation with his friend Lambert, Baron never committed himself to the offer or proposal. In fact, Lambert expressed his surprise at the first payment that Baron made due to his financial position at the time (Thomson Reuters, 2021). This reaction may confirm Lambert’s knowledge that Baron did not accept his offer despite his silence.

Do you agree with the outcome of the case?

I agree with the court’s ruling on the case. Baron may have felt indebted to his friend for the trouble he took to offer assistance in the form of advice when he needed it. This feeling may have led to the initial payment and the refusal to make additional payments as expected of Baron by Lambert. The court concluded that the case involved a friend helping a friend (Thomson Reuters, 2021). This conclusion is founded on the lack of recorded evidence that Lambert may have presented in court except for the first payment’s documentation. In addition, Baron lacked substantive benefits from the consultation that Lambert offered.
