Discussion – The Child Abuse Prevention and Treatment Act (CAPTA)

The Child Abuse Prevention and Treatment Act (CAPTA) was considerably enhanced by the Justice for Victims of Trafficking Act of 2015 because it explicitly addressed how to protect trafficked children. The first requirement of this 2015 Act was that it mandated all states to find, evaluate, and address cases concerning children who were either known victims or suspected victims of sex trafficking (Children Welfare Information Gateway, n.d.). Secondly, states were mandated to include in their CAPTA State plans provisions that necessitated these actions and guarantee that child protective services workers were taught how to identify and respond to sex trafficking cases. Such actions comprise cooperation with social service agencies, juvenile justice and law enforcement agencies (Children Welfare Information Gateway, n.d.). In addition, the policy also expanded the federal definitions of the terms “sexual abuse” and “child abuse and neglect” to specifically take account of children identified as victims of sex trafficking. This was done to ensure that these at-risk children receive the needed protection and services under CAPTA.
