The experiences of Mr. And Mrs. Watros and their decision to sue the hospital on professional malpractice allegations are due to the negligence of the nurses. For risk managers to prevent initial actions that lead to related reactions, it is important to identify the level at which negligence occurs. Negligence occurs when nurses and other healthcare practitioners fail to abide by the standards of care, ethics, and codes of conduct and follow basic care procedures such as communication with the patient, failing to document, assess, and monitor the patient’s condition, and failure to advocate for the patient to access timely care (Youngberg, 2010).
In the Watros case, the nurses failed to attend to the couple for nearly two hours. The patient’s conditions were also not assessed, documented, or monitored throughout the waiting period, which could have led to unintended complications during delivery. Also, the nurse failed to act professionally as per the standards of nursing practice and provide care to the couple by claiming they could do nothing as their shift had ended. The nurse also slid on the wet floor due to negligence of the facility’s physical safety standards.

Negligence is related to the initial action; therefore, the action and reactions can be prevented. Banazadeh et al. (2021) observed that the negligence of nursing duties and overfocusing on nursing routines led to the negligence of other aspects of the nursing role. Therefore, negligence must be prevented by ensuring that the nurses are always prepared to handle cases and follow proper procedures that lead to satisfying the expectations of the patients regardless of whether they are on duty or not. The nurses are also required to maintain their expertise and abide by the ethics of practice in nursing. Training the nurses on interpersonal skills can ensure a positive relationship is maintained with the patients and other physicians.

Mr. And Mrs. Watros came to the Memorial Hospital for the delivery of their first child. While Mrs. Watros was in labor, the couple had to wait for nearly two hours to get a room. During that time, no hospital nurse attended to her. As the waiting room was full of patients, an exhausted Mrs. Watros sat on the floor. Mr. Watros reported this to a nurse. The nurse responded that it was past her shift, and she could do nothing.
These problems were later reported to a physician. The physician said, “It is just the way things go wrong here sometimes. You just have to get used to it.”
After delivery, the nurse carrying the infant slipped. The baby was unharmed. The explanation given was, “there was disinfectant fluid on the floor, which makes the floor a little slippery.”
On discharge, Mr. and Mrs. Watros decided to sue the hospital. The physician admitted negligence and poor treatment, but did not see a reason to apologize.
