Carlos Ghosn turned from a corporate messiah to a sought-after criminal. Unfortunately, his career had a terrible end despite the hours and effort he put into his work. Even critics commend his remarkable work in managing the three companies, Nissan, Renault, and Mitsubishi. Ghosn’s mistake was more of increased business rivals rather than his failure in fulfilling his tax obligations. From my perspective, hadn’t Ghosn pursued large-scale expansion through implementing mergers and acquisitions to create a big company, this would have been a different story. Just before his prosecution, Ghosn was eyeing a merger with Fiat Chrysler. The firm’s key competitors must have seen the looming danger from Ghosn’s ambitions and hence searched for a loophole that they would exploit to trash his dream. Ghosn is treated like a criminal in spite of his impeccable work ethic and commendable performance. It is important to note how he revived Nissan and saved the firm from bankruptcy, hence saving thousands from unemployment. Managing the three companies, Nissan, Renault, and Mitsubishi, was a painstaking task given the scale of operations. While I do not condone the unethical practice of tax avoidance, I believe that Ghosn deserved a less stringent punishment. Tax evasion is quite prevalent in the present world, as seen by various sports personalities and business persons, to the extent that some of them file for citizenship in tax havens. Yet the offenders continue with their careers amid court cases. Similarly, Ghosn should have been sued but left to run the three companies since he had demonstrated his acumen in corporate leadership. Notably, the three companies’ performance has considerably declined since the onset of Ghosn’s persecution. Failure to adhere to ethical practices, particularly correct tax reporting, could lead to a downfall in spite of years of hard work.

This article assignment relates to an interesting story regarding Carlos Ghosn, who previously masterminded the successful turnarounds of both Nissan and Peugeot, became the CEO of both companies and helped Mitsubishi. Mr. Ghosn was known as a workaholic CEO and would fly back and forth each week between Tokyo and Paris, where the companies are headquartered. He was considered a pioneer CEO with great vision and commanded a large compensation package. Then, in November 2018, Mr. Ghosn was suddenly arrested after landing in Tokyo on charges of understating his tax obligations. There was then much publicity about the alleged unfairness of the Japanese prosecution system regarding Mr. Ghosn’s treatment as compared to US prosecutions. (Over 99% of cases that go to trial in Japan result in a conviction, usually based on a confession.)

Then, on New Year’s Eve of 2020, Mr. Ghosn arranged a daring escape to his birth home in Lebanon with the help of a team of people, including a former green beret literally involving planes, trains, automobiles and a large musical box. He is currently preparing his criminal defense from Lebanon. Neither Peugeot nor Nissan has been able to attain the financial success that they had since Mr. Ghosn’s departure.
