England has a mixed legal system that combines the elements of common law and civil law. The system includes three major jurisdictions, which are England, Northern Ireland and Scotland. Every jurisdiction has its own lawyers, court system, and laws. However, laws that are applicable in one jurisdiction, especially if they are drawn from legislation, may apply similarly or equally in other jurisdictions. In courts, every jurisdiction can decide cases differently from the ones in other jurisdictions, but the final appeal goes to the Supreme Court. Colonization mainly transformed England’s legal system into a mixed system because it was the main system applied in most British colonies. Observing its effectiveness in the colonies, therefore, prompted them to consider it to enhance the effectiveness of law enforcement in the country.

As an entrepreneur within the selected country, identify a socioeconomic problem in that country and a product or service that addresses this problem. Analyze this product or service through the specific steps of a market screening.

The main socioeconomic problem in England is that there is a high population of the elderly and limited quality care for them, hence increasing mortality among the elderly. The government has withdrawn funding for assisted living and nursing facilities, hence making it hard to operate them, which has resulted in poor services in the facilities and underpayment of staff. I would, therefore, open an assisted living facility or nursing home to address this problem. The facility would focus on providing quality care for the elderly, including giving them medication, psychological care, physical exercises, and proper nutrition. It would target the elderly aged 75 years and above in the middle and lower economic classes, particularly those living alone with no one to take care of them.

Describe how likely it is for an entrepreneur to enter the market considering the current legal system. Justify your response.

Entering the current market is hard due to the current legal system, which has strict restrictions on quality control to ensure that assisted living facilities and nursing homes meet the required standards of care. For instance, the facility will be required to follow the regulations put in place by the Care Standards Act 2000 and the Regulation of Care Act 2001, which establish regulatory frameworks for all care homes in the United Kingdom. The business will have to undergo an inspection to ensure that it meets the standards of care as provided by the Care Standards Act 2000. The main requirements will be ensuring that the facility has sufficient staff, promotes the residents’ quality of life, assesses each resident’s specific needs, submits to unannounced inspections and allows resident interviews, develops detailed care plans for every resident, including proper nutrition, hygiene, medication, and diet, keep complete and accurate medical records for every resident, ensure that residents are adequately supervised and maintaining residents’ respect and dignity. Some of the penalties that the facility may face for failing to meet these regulations include imposed staff training, fines, increased monitoring, and temporary outside management. The facility will also be required to observe the residents’ rights. The rights include the right to be treated with dignity and respect, the right to be free of physical restraints, the right to be free of mistreatment, abuse, and neglect, the right to privacy, the right to communicate freely, the right to participate in family or social groups, the right to voice grievances without retaliation and the right to make decisions about their care.

Evaluate two international market entry methods for the product or service in the selected country. What are the advantages and disadvantages of each method?

One of the international market entry methods for assisted living and nursing home services in England is strategic alliances. According to Sengupta (2007), this market entry method includes establishing a relationship with two or more businesses in the host country to achieve shared objectives. The main advantages of this entry method are reduced cost and risk of operating in the new market, having access to an existing customer base, and reduced cost of acquiring raw materials. The main disadvantages are loss of control that may arise from the fact that the business in the host company has all the licenses required to operate the business and the risk of competition when the partnering business creates potential competition. The second market entry strategy is direct exporting. This strategy includes directly exporting a product or service to the chosen market. The main advantages of this strategy are having full control over the product and attractive returns once the client base is established. Direct marketing also eliminates middlemen hence increasing the profit margin because revenue flows to the company directly. The main disadvantages are larger risks because of lack of proper knowledge about the market and high operating costs. A company may also face intense competition when using direct exporting because of venturing into a market that is already dominated by other companies that have established a customer base in the market.

Taking into consideration the cultural, societal, and religious values, provide examples of effective and ineffective advertisement practices you would implement to introduce the product or service into the selected country. Explain your reasoning.

The most effective advertising strategy that I would implement to introduce the service is content marketing. According to a study conducted by Statista (2018), content marketing strategies are the most effective marketing strategies in the United States and were rated as the most critical strategies in achieving market success by 65% of the marketers who were involved in the study. Content marketing includes the use of videos, blogs, social media posts, and infographics. The main ineffective strategies that would limit the effective introduction of the service are word-of-mouth marketing and using leaflets. This is mainly because most elderly people do not leave their homes and may only be reached via their friends or neighbors who are mainly active on social media platforms.

For the selected product or service, recommend at least two legal compliance approaches that should be used by companies when conducting international business in the selected country (e.g., employment law, tax law, advertising law, corporate law).

One of the legal compliance approaches that should be used by the company when conducting international business in England is complying with the requirements of the Care Quality Commission, which regulates, inspects, and monitors adult social care to ensure minimum safety and quality standards are met. I also need to be registered as a care home manager (Stevens & Milligan, 2019). The main requirements for a care home manager in England are of good character, being physically and mentally capable of performing the role, and having the necessary experience in providing elderly care. I will also have to adhere to employment laws that require all employees to be of legal employment age. In England, children under the age of 16 years are allowed to work in a full-time position but can work for a limited number of hours.

For the selected product or service, provide two key recommendations to consider regarding ethics and social responsibility in your selected country (e.g., intellectual property, competition, corruption).

One of the ethical considerations that I need to observe is ensuring that the elderly are not mistreated and that they are granted the right to privacy. I, therefore, have to ensure that their medical records are not disclosed to anyone without their authorization and that their stay in the facility is only disclosed to those he or she wishes to inform. I will observe social responsibility by providing quality care to all residents despite their economic level. I will additionally ensure that all waste is disposed of appropriately to avoid exposing the community around the facility to health risks arising from waste such as needles, gloves, and used diapers.
