The education sector in different states across the United States is regulated through laws and policies created by the federal and local governments. According to Trimmer et al. (2018), the laws are important to the educational professionals in charge of all aspects of educational entities, public pre-K12 schools, and higher education. The federal government’s involvement in passing laws and policies that regulate education began after a peaceful March held in Washington (Miller Center, 2023). The peaceful March initiated discussions about the civil rights legislation in the United States, the need for fair employment practices and the importance of education and training. Since then, Congress has been actively involved in making and discussing policies that impact students and teachers and focus on improving the quality of education and safety of learners. However, the policies and laws may vary based on the state and the needs of learning institutions in the state. FindLaw (2024) argues that every state provides laws governing the termination and hiring of teachers, education agencies, and teachers’ tenure. For instance, in North Carolina, the law allows schools to dismiss teachers for immorality, inadequate performance, neglect of duty, insubordination, mental or physical incapacity, and the conviction of a crime involving moral turpitude and excessive or habitual use of alcohol and other controlled substances. This policy has played a vital role in boosting the performance of public schools in North Carolina because teachers are committed to maintaining high performance to avoid dismissal.

Education policies impact the functions within learning institutions, including the roles and responsibilities of the students and teachers and the policies and procedures in the student and teacher handbooks. North Carolina’s education policy is sound because it focuses on ensuring that teachers are held accountable for their actions. The policy also aligns with best practices because it emphasizes creating a conducive learning environment for learners and ensuring that teachers maintain professionalism. It also enables schools to meet the required standard of a safe learning environment and promotes professionalism among the teachers. According to Wells and Clayton (2016), schools in the United States are expected to accept responsibility for the children within the school compound. Teachers are also responsible for providing the learners with emotional, social, and physical safety. Therefore, the North Carolina policy enables schools to offer a safe environment for the learners by ensuring their teachers are not convicted criminals or immoral. The policy also ensures that teachers meet their responsibility of providing quality education to the children by preventing underperformance and neglect of duty.

Although North Carolina’s policy has been effective in maintaining the professionalism of teachers in schools across the state, I would recommend a few changes to ensure that the policy is clear and cannot be misinterpreted to suit the needs of a specific party at the expense of the other party. For instance, the policy should be amended to include examples of crimes that can be considered to involve moral turpitude to guide those interpreting it to determine its applicability in different situations. The policy should also be amended to specify who is responsible for dismissing the teachers. The policymakers should also include guidelines on the steps that should be followed in the termination of teachers who are accused of immorality, inadequate performance, neglect of duty, insubordination, mental or physical incapacity, conviction of a crime involving moral turpitude, and excessive or habitual use of alcohol and other controlled substances to ensure that they are treated fairly.
